These terms apply when you use Studbid, an iPhone app published by HOMERUNUNIT L.L.C., a Michigan limited liability company ("we", "us"). By downloading or using the app, you agree to them. If you do not agree, do not use the app.

What Studbid is

Studbid is a record-keeping tool for remodeling contractors. It helps you write estimates, record a customer's approval, send invoices and receipts, price change orders, keep photos and notes, and organize your own numbers. It is software you use to do your own work. It is not a service we perform for you.

Your work and your customers

Studbid is only a tool for preparing estimates, invoices and records. We are not a party to any agreement between you and your customers, and we are not involved in the work, the price, the quality of the work, any warranty you give, or any payment between you and your customer. Any dispute about a job, a change, a charge or a payment is between you and your customer.

It is not legal, tax or accounting advice

Studbid includes general information about certain federal and state rules that can affect remodeling work, such as a buyer's right to cancel, limits on deposits, and lien waivers, along with notice text and links to official forms. This information is drawn from official government sources as of the date it was added, and it is provided for convenience only. Laws change, vary by state, county and city, and depend on your situation, your license and your contract. We do not verify that any rule, form, cap, date or notice applies to you or to a particular job.

You are responsible for your contracts, your notices, your licensing, the deposits you take, the sales tax you charge, collect and remit, and what you report on your tax return. Confirm all of it with a licensed attorney and a qualified tax professional in your state. Do not rely on Studbid as your only source for any legal or tax decision.

Your data

Your data lives on your device and, if you leave it on, in your own iCloud account. We do not host your customer records. Backup and restore depend on Apple's iCloud service, your device and your settings, and we cannot guarantee they will always work. Keep your own copies of anything you cannot afford to lose.

Your content

Everything you type or add in Studbid, including estimate and invoice wording, scope, warranty text, notes, business details, prices, photos, signatures and customer information, belongs to you. You are responsible for that content, for making sure it is accurate and lawful, and for having any rights or permissions it requires, including permission to store and use your customers' information and to share photos of their property. We do not review or approve it.

Signatures and approvals

The app lets you record how a customer approved a paper, including a signature drawn on your phone. Whether an electronic signature or a text-message reply is enforceable depends on the law that applies to you and on how you use it. We make no promise that any approval recorded in the app will be accepted by a court, an insurer or anyone else.

Payment and subscriptions

Every new install includes a number of estimates at no charge. Paid subscriptions are sold through Apple and billed by Apple to your Apple Account. Prices are shown in the app before you buy. Manage, cancel or request a refund for a subscription through your Apple Account settings or by contacting Apple. We cannot process refunds for purchases Apple handled.

What you may not do

Do not use Studbid to break the law, to create false or fraudulent records, or to harass anyone. Do not attempt to reverse engineer, resell or redistribute the app.

No warranty

Studbid is provided "as is". We do not warrant that it will be uninterrupted, error free, or that every calculation, paper, notice or export will be correct for your situation. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limit of liability

To the fullest extent allowed by law, HOMERUNUNIT L.L.C. is not liable for lost profits, lost data, lost business, unpaid invoices, liens, penalties, interest, or any indirect, incidental, special or consequential damages arising from your use of Studbid. Our total liability for any claim will not exceed the greater of the amount you paid for the app in the twelve months before the claim, or twenty-five US dollars.

Some states do not allow certain limits, so parts of this section may not apply to you.

Changes to the app and to these terms

We may update, change or discontinue features. We may update these terms; when we do, we will change the date at the top of this page. Continuing to use the app after a change means you accept the updated terms.

Ending your use

You may stop using Studbid at any time by deleting it. We may suspend or end your access if you break these terms.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Washtenaw County, Michigan, and you and we agree to the personal jurisdiction of those courts.
